To the extent allowed by law, the consumer reports may include information concerning your character, general reputation, personal characteristics, mode of living, drug and alcohol test results, motor vehicle records, driving records, criminal information, public court records, employment history (including names and dates of previous employers, reason for termination of employment, work experience, and accidents), social security number validation, education, licensure, or verification of other information supplied by you. Such reports may be obtained from private and public record sources, including sanctions databases, CDLIS, former employers, public court records, and federal, state, and other government agencies that maintain such records.

Consent for Limited Queries of the Federal Motor Carrier Safety Administration (FMCSA) Drug and Alcohol Clearinghouse

I hereby provide consent to Land Trucking LLC. to conduct a limited query of the FMCSA Commercial Driver's License Drug and Alcohol Clearinghouse to determine whether drug or alcohol violation information about me exists in the Clearinghouse. I understand this consent shall remain on file and shall serve as ongoing consent for Land Trucking LLC. to conduct multiple limited queries of the Clearinghouse at any time during my employment or contract period without asking me for additional consent.

I understand that if I refuse to provide consent for Land Trucking LLC. to conduct a limited query of the Clearinghouse, Land Trucking LLC. is required to prohibit me from performing safety-sensitive functions, including operating a commercial motor vehicle.

I understand that if the limited query conducted by Land Trucking LLC. indicates that drug or alcohol information exists about me in the Clearinghouse, the FMCSA will not disclose that information to Land Trucking LLC. unless I give additional specific consent within the Clearinghouse. However, I understand that Land Trucking LLC. will be required to conduct a full query of the Clearinghouse within 24 hours after a limited query indicates that drug or alcohol information exists and that if I do not grant consent within the Clearinghouse for that full query I will be removed from performing safety-sensitive functions, including operating a commercial motor vehicle.

Acknowledgement of Driver Notification and Deposit Deduction Policy

This letter serves as acknowledgement that I (), have read, understood, and agree to comply with the Driver Notification and Deposit Deduction Policy of Land Trucking LLC.

I understand that I am required to provide Two weeks' written notice to the management before leaving the company, and that failure to do so will result in a deduction of Deposit the amount.

I acknowledge that I have received a copy of the policy and understand my responsibilities and obligations under this policy.

I agree to comply with the terms and conditions outlined in the policy, including providing written notice and cooperating with the management during the notice period. Furthermore, I commit to continuing to perform my job duties to the best of my abilities and in good faith until the end of the notice period.

I understand that this policy is a condition of my employment with Land Trucking LLC, and that failure to comply with this policy may result in the deduction of the specified deposit amount.

Contract between Land Trucking LLC and Driver

Parties:

  • Land Trucking LLC (hereinafter referred to as "Company")
  • Driver Name: (hereinafter referred to as "Driver")

Effective Date:

Purpose: This contract establishes the terms and conditions regarding the operation of refrigerated trailers (hereinafter referred to as "reefers") by the Driver, ensuring continuous operation to protect the integrity of the transported goods.

Terms and Conditions:

  1. Continuous Operation Requirement:
    • The Driver acknowledges and agrees that the reefer units must be operated on a continuous mode at all times during transportation to maintain the required temperature for the goods.
    • The Driver shall not switch the reefer units to start/stop mode under any circumstances.
  2. Liability for Damages:
    • In the event that the Driver operates the reefer units on start/stop mode, the Driver shall bear full responsibility for any and all claims, costs, and damages resulting from the improper temperature control, including but not limited to the spoilage of goods.
  3. Compliance with Instructions:
    • The Driver shall comply with all instructions provided by the Company regarding the operation and maintenance of the reefer units.
    • Failure to comply with these instructions may result in disciplinary action, including termination of this contract.
  4. Indemnification:
    • The Driver agrees to indemnify and hold harmless the Company from any claims, losses, damages, or expenses arising from the Driver's failure to operate the reefer units in accordance with the terms of this contract.

Vehicle Maintenance Breakdown and Road Repair

It is the goal of LAND TRUCKING LLC to minimize on the road equipment breakdowns through our strong vehicle inspection and preventive maintenance programs. We are committed to providing our drivers with expedient and reliable breakdown and road repair service.

During a vehicle breakdown, driver and public safety, along with our customer needs, are our top priorities. To meet these priorities, LAND TRUCKING LLC has implemented the following vehicle breakdown and road repair procedures that all drivers will be trained in and are expected to follow.

Responsibility:

Safety, Drivers, dispatchers, and the maintenance department must know and apply the following procedures. We must not take on roles outside of the scope of this policy. We must only address mechanical problems that are within the realm of knowledge or authorization.

Procedures:

The vehicle breakdown procedures are developed to insure the safety of our drivers and the motoring public, securement of the equipment and its cargo, timely customer notification of any shipment delay, and facilitation of expedient equipment repair.

All LAND TRUCKING LLC drivers are expected to follow these procedures in the event of a breakdown.

Before any work assignment you must give your vehicle a complete pretrip inspection. Check your service brakes, brake hose connections, parking brake, steering, all lights and reflectors, tires, horn, windshield wipers, all mirrors, and coupling devices for road readiness.

You are required to make certain that the vehicle is equipped with required emergency gear.

All company vehicles (owned, leased, or contracted) will be equipped with a fully charged fire extinguisher, fuses, and warning signals. Any missing or need of charging must be corrected immediately. The vehicle should not be started on a trip without all required emergency gear. Minor vehicle breakdowns are those requiring simple repairs such as replacing a headlamp, a fuse, a trailer reflector, etc.

All LAND TRUCKING LLC vehicles must carry spare parts necessary for quick and efficient repairs of minor breakdowns, examples are: fuses, headlamps, fuel and oil filters, spare flasher light bulbs, trailer reflectors, etc. Drivers should consult with their supervisor or maintenance personnel to obtain adequate vehicle spare parts inventory.

When a breakdown occurs

When an equipment breakdown occurs requiring road repair assistance, the following procedures must be implemented:

Breakdown Procedures:

  • Safely stop and secure the vehicle: Do not leave the vehicle unattended until parking brake is set and the vehicle is secure. If in motion, activate hazard flashers and park safely.
  • Place warning devices: Within 10 minutes, as prescribed in Sec. 392.22. Deactivate flashers once devices are placed.
  • Communicate breakdown: Provide exact location (road/highway, mile marker/exit, direction), suggested diagnosis, and tire size/location if it's a blown tire.
  • Stay with vehicle: When signaling through LAND TRUCKING LLC satellite communications system, the driver must stay with the vehicle for updates. Dispatch handles contacting the driver.
  • Notify dispatch after repairs: Once repairs are made, the driver notifies dispatch, turns on flashers, and safely removes warning devices.
  • Paperwork: All repair paperwork is forwarded to the Safety Department and kept on file for 12 months.

After hours breakdowns: Drivers are to contact their assigned dispatcher, or assistant dispatcher if unavailable.

LAND TRUCKING LLC breakdown responsibilities:

Driver's responsibilities:

  • Safely stopping and securing the vehicle and load.
  • Safely placing the warning devices.
  • Diagnosing and calling in the breakdown.
  • Notifying dispatch when repairs have been made.
  • Safely removing the warning devices.
  • Forwarding all repair paperwork to the Maintenance Department.

Dispatch operations responsibilities:

  • Notifying the customer of any delays.
  • Locating, contacting, and dispatching a vendor for repairs.
  • Taking care of all billing.
  • Obtaining all repair records.
  • Following up with the driver.
  • Rescheduling customer appointments.

Note: If a breakdown occurs during normal business hours, drivers contact their assigned Dispatcher.

Acknowledgement of Receipt Form

Unsafe Driving and Local Laws Policy

Statement of Purpose and Policy

Our drivers are valuable members of Land Trucking LLC; however, we are concerned about their safety. Failure to comply with local laws such as seatbelt, speeding, lane maintenance, and all other traffic laws poses a threat to driver and public safety. It is the Company's policy that non-compliance with local laws indicates an unsafe driving habit and will not be tolerated.

The adverse impact of such driving habits is acknowledged by the federal government. The Federal Motor Carrier Safety Administration (FMCSA) indicates in 392.2, that all local laws must be complied with, and that compliance is a condition of continued employment with the Company.

Land Trucking LLC's policy is that a pattern of non-compliance, including moving violations or oversize/overweight violations (in company or personal vehicles), may result in termination of employment or lease for independent contractors.

Violations can be brought to the Company's attention through various methods: Annual Motor Vehicle checks (federal regulation), monitoring services, information from state or law enforcement (Driver/Vehicle Examination reports), or driver disclosure. All received information will be used to ensure policy compliance.

Drivers with repeated or excessive violations will be subject to a corrective action schedule.

The Company reserves the right to impose more stringent consequences based on circumstances and severity of violations, with situations judged on a case-by-case basis before the phased corrective action begins.

Texting while Driving:

Will result in immediate termination. This is unacceptable behavior and will not be tolerated. Receipt of this policy serves as your only warning for this violation.

All other moving violations and violations of local laws:
  • Phase 1: Verbal warning for 1 moving violation in 12 months.
  • Phase 2: Written warning for a 2nd violation within 12 months.

Reaching Phase 2 indicates an unwillingness to obey laws and ordinances, both local and federal. Drivers in Phase 2 will face disciplinary action, including suspension and possible termination of employment or lease agreement.

Motor Vehicle Records will be monitored every 90 days for compliance. Drivers are still required to inform the Company of convictions as per federal regulation. A copy of the final written warning will be placed in the driver's file, and all such entries must include date, time, and signatures of the driver, supervisor, and/or Safety Department representative.

By signing this policy, I acknowledge I have read it, I understand the consequences, and I agree to this policy as a condition of my employment or lease agreement.

ACCIDENT REPORTING

Accident Reporting: In the event that you are involved in an accident of any kind while operating a LAND TRUCKING LLC vehicle, you must do the following:

  1. Report it to the local Authorities
  2. Notify your Immediate Supervisor/Dispatcher/Safety Manager
  3. Obtain as much information possible from the other party
  4. Remain calm and courteous at all times
  5. There are 3 circumstances under which a Post-Accident Drug & Alcohol test MUST be conducted according to FMCSA/DOT regulations. The Drug Test must be conducted within 32 hours of the accident, the Alcohol Test within 2 hours. If the Alcohol Test is not conducted within 2 hours, the employer should continue to make and effort to have the driver tested for up to 8 hours.

UNAUTHORIZED PASSENGERS

  • VIOLATION CFR § 392.60 Unauthorized persons not to be transported: "LAND TRUCKING LLC" will NOT permit any employee and/or independent contractor to allow another passenger in his/hers CMV (Commercial Motor Vehicle) or a CMV that is owned or lease under "LAND TRUCKING LLC" without "LAND TRUCKING LLC" authorization:

A. Unless specifically authorized in writing to do so by the motor carrier under whose authority the commercial motor vehicle is being operated, no driver shall transport any person or permit any person to be transported on any commercial motor vehicle other than a bus. When such authorization is issued, it shall state the name of the person to be transported, the points where the transportation is to begin and end, and the date upon which such authority expires. No written authorization, however, shall be necessary for the transportation of:

  1. Employees or other persons assigned to a commercial motor vehicle by a motor carrier
  2. Any person transported when aid is being rendered in case of an accident or other emergency
  3. An attendant delegated to care for livestock.

B. This section shall not apply to the operation of commercial motor vehicles controlled and operated by any farmer and used in the transportation of agricultural commodities or products thereof from his/her farm or in the transportation of supplies to his/her farm.

Cargo Securement Policy

Land Trucking LLC is committed to ensuring that all freight is secured. Land Trucking LLC Safety Department will ensure that all drivers have been properly trained in the handling and securing of freight. All drivers must secure the cargo and make sure that it is properly distributed.

A load is secure when no cargo can slide, shift, fall, shift onto the roadway, or become airborne.

  • Secure all cargo to prevent movement forward and backward, side to side, and up and down.
  • Secure all cargo against wind and other forces that can cause it to become airborne.
  • Secure all cargo against shifting through the bed of a truck or trailer and onto the roadway.

~~ Many accidents and injuries could be prevented simply by securing vehicle loads.

Drivers Responsibilities:
  1. Before driving the vehicle
  2. The driver must inspect the cargo every time he changes a duty status
  3. the first 50 miles
  4. the first 150 miles or three hours whichever comes first
  5. Ensure that the cargo does not interfere with your ability to safely operate the vehicle
  6. Make sure that cargo is properly distributed and adequately secured
  7. Make sure that all securement equipment and vehicle structures are in good working order and used consistent with their capability.
  8. Make sure that nothing obscures front and side views or interferes with the ability to drive the vehicle or respond in an emergency.
  9. Inform carrier if packaging is not adequate.

** If the cargo is sealed in a vehicle and the driver has been ordered not to inspect the cargo, then the driver is not required to inspect the cargo.

HOS Policy

Hours of Service Policy

All drivers must follow the following driving regulations:

  1. Maximum Driving Hours: Drivers are required to drive no more than a maximum of 11 hours within a 24-hour period. (Driver should not drive more than 600-625 miles a day to stay within the 11-hour maximum).
  2. Required Off-Duty Hours: After which the driver is required a total of 10 consecutive of OFF DUTY hours before starting to drive again.
  3. Maximum On-Duty Hours: Drivers cannot work after the maximum of 14 hours on duty per day. Drive must be off a total of 10 consecutive OFF Duty hours before starting to drive again.
  4. Required Break: Driver must take a 30 minutes OFF DUTY or SLEEPER BERTH break before being on duty for 8 hrs.
  5. Weekly On-Duty Limits: All drivers must follow the maximum of 60 hours on duty in any 7 consecutive days, or if working every day of the week, a maximum of 70 hours on duty in any 8 consecutive days. Once the driver reaches these limits, he/she cannot drive until they have completed 34 consecutive hours of off duty.

Drivers that are cited during roadside or scale inspections for violations of the 11 hour, 14 hour or working beyond the 60/70 hours, will be:

  • 1st Offense -Written up and re-trained
  • 2nd offense, written up and suspended for one day,
  • 3rd offense written up, pay a fine and suspended for a week.
  • 4th Offense, termination of contract.
Completion of Logs

All Commercial Drivers are required to login to ELD and complete a daily vehicle record (log) for all 365 days of the year.—No exceptions.

  • If driver is off duty for a day, weekend, a holiday period of several days, or even a month's vacation, driver must complete a log for the entire period. Enter dates in the Remarks section and show the off-duty time on the grid/log.
  • If working as team, each driver must login using their own login information and complete their logs. NO EXEPTIONS
  • Drivers must keep their daily logs current to the time shown for the last change of duty status. This means that daily log must be up-to-date at all times.
  • Drivers must sign and acknowledge that all entries input into the Daily Log book are correct by the end of day.
  • Driver is to use Personal Conveyance for personal use or personal as off duty as off-duty only when the driver is relieved from work and all responsibility for performing work by the motor carrier. NO EXEPTIONS. If clarification is needed, please contact your safety manager ASAP.
  • If the ELD is malfunctioning, driver must: write a note on the ELD, notify his safety manager right away and use his 7 days of blank paper log until the device is working.

HOS Policy

If paper logs are used for more than 7 days, Safety management needs FMCSA approval.

Daily Vehicle Inspection Reports (DVIR's) must be completed by the driver, documenting any defects or services and providing supporting documentation.

Drivers must document the exact time, date, and location of fueling on their logs, matching fuel receipts.

All road and scale inspections must be documented on the log, including location and time.

The following information is required for the proper completion of logs:

  1. Name of driver
  2. Date
  3. Total miles driving in a day (24-hour period)
  4. Truck or Tractor and trailer numbers
  5. Name of Motor Carrier/Company
  6. Carrier's main office address
  7. Name of co-driver (if applicable)
  8. Total hours for each duty status (Off Duty, Sleeper/Berth, Driving, and On-Duty)
  9. Shipping document number(s), or name of shipper and commodity
  10. In the Remarks section, the driver must indicate the location (city) for changes in duty status
  11. Acknowledgement of completed ELD by end of day

Electronic Logging Device (ELDs) - Policy

Before You Start Driving
  1. Ensure your device functions correctly. You should check the functionality of your ELD before you begin driving. Portable devices should be fully charged. If your device is not functioning correctly, report issues in writing to your carrier to create a record of the problem.
  2. Verify ELD documentation is accessible. You should ensure that you have the three required ELD documents in the cab or accessible electronically: "Transfer Guide", "ELD Manual", and "Malfunction Guide".
  3. Keep backup paper logs on board. You must have at least 8 days' worth of blank paper logs on hand, in addition to the three ELD documents, to avoid violations.
  4. Check the driver interface and placement. Ensure that the driver interface is mounted to the vehicle, in line of sight, and compliant with state rules (e.g., no windshield mounting). Portable devices must be securely mounted.
Roadside Inspections

You should first ask the officer what method of transfer they support. Transfer mechanisms are "local" (USB or Bluetooth) and "telematics" (wireless via ELD provider and email). Telematics is becoming the preferred method.

If your ELD supports the requested method, follow the "Transfer Guide" instructions to transfer logs electronically.

If your ELD does not support the officer's requested option or fails to transfer logs (due to missing info, no cellular connection, or other issues), refer to your ELD manual for instructions on a secondary option, which is typically an on-screen display or printout. This backup is compliant.

If an error occurs during transfer, note the display and inform your carrier's administration. Even minor issues, like an improper character in a DOT number, can stop a transfer.

LAND TRUCKING LLC has transitioned to ELDs, and compliance with hours-of-service regulations is a condition of employment.

Malfunction Reporting

All malfunctions or equipment failures must be documented and submitted to LAND TRUCKING LLC personnel. Report within 24 hours to the following:

LAND TRUCKING LLC will determine if a replacement unit is required or if a repair is needed within 8 days of notification.

Paper Log Requirements

Drivers must always have blank paper logs in the truck.

  • A minimum of 8 days of blank paper logs is required per driver.
  • Team drivers require a total of 16 blank logs.
Log Completion and Accountability

Drivers are accountable for completing their logs correctly and submitting them on time. Drivers who incur violations for not having or completing logs properly will be held responsible by LAND TRUCKING LLC. Drivers are responsible for paying fines associated with these violations.

Record Retention

LAND TRUCKING LLC is required to keep the last 6 months of logs for all active and terminated drivers for audits. Drivers are reminded to complete daily logs properly and on time.

Falsification of Logs

LAND TRUCKING LLC will not accept grossly falsified logs. Drivers found falsifying logs will be subject to disciplinary action, suspension, and up to termination.

Driver has read and understands all requirements relating to their duty of record (logs).
